A Kibera Court on Tuesday, April 15, 2025, granted two directors of Omnicare Medical, also known as Body by Design, a plastic and cosmetic surgery clinic and a surgeon Ksh1 million bond with surety or cash bail of Ksh500, 000 with one contact person.
In his brief ruling, Senior Principal Magistrate Samson Temu also ordered that the directors George Wakaria Njoroge, Lilian Edna Wanjiru, and surgeon Robert Maweu Mutula should refrain from contacting any of the witnesses in the case and that the business premises should remain closed.
“The accused persons to refrain themselves from contacting any witnesses in the list, the business premises to remain as it is and the matter to be heard on priority bases,” Senior Principal Magistrate Temu ruled.
Additionally, Senior Principal Magistrate Temu directed the state to supply the defence with all the witnesses’ statements and documents they want within the next 14 days.
He also stated that in the earlier submission that the accused would interfere with witnesses who were employees did not hold water since there was information that the clinic was shut down, meaning that there were no employees under the management of the accused persons.
However, the court rejected an application by the legal team representing Francis Ng’ang’a husband to the late Lucy Wambui to defer the ruling of the bail to Wednesday, April 16, 2025, so as to give Ng’ang’a a chance to amend his statements that he recorded with the probation officer.
“Mr. Francis Ng’ang’a, who is in present in court would like to give the accurate statements that he made for the court to consider even if it means having him address the court or even file an affidavit by close of business today for your consideration and have the ruling be delivered tomorrow,” Ng’ang’a legal team told the court.
In his response, Senior Principal Magistrate Temu stated that the victim’s interests would be taken care of in the course of the trial.
Lucy Wambui is said to have undergone a liposuction procedure with the intent to remove excess fat from her body at Omnicare Medical in mid-October 2024.
After she was discharged and while at home, she developed some complications prompting her to return to the clinic, which referred her to Nairobi Hospital, where she underwent emergency surgery on October 23, 2024, during which surgeons discovered multiple perforations in her intestines.
She later died on October 26, 2024, with a postmortem showing she died from extensive internal complications following the liposuction procedure.
The matter will be mentioned on April 28, 2025, for further directions.
