Nairobi Court on Monday, March 3, 2025, allowed police to continue holding two persons of interest linked to the murder of British national Campbell Scott Alistair.
Milimani Law Courts Chief Magistrate Lucas Onyina ordered the two, namely Alex Mutua Kithuka and Albunus Mutinda Nzioki, to be remanded for 21 days to enable investigators to complete investigations.
The magistrate ordered the two to be remanded at the Capital Hill and Kilimani police stations.
“The court considered the content of the affidavit and submissions and orders the two to be remanded as requested by the investigative officer for a period of 21 days,” Chief Magistrate Onyina ruled.
However, Alex Mutua requested the court to reduce the 21 days of investigations, a request that was not granted.
Interference with investigations
The Director of Public Prosecution (DPP), through lawyer Joyce Olajo, told the court that the two were likely to interfere with the ongoing investigations if released on bond.
Further, Olajo stated that the investigating officer Philip Kilonzo was still pursuing the other persons of interest believed to have been involved in the murder of Alistair.
Olajo said that the two were also a flight risk and could fail to appear in court if released on bond.
Notably, the court was told that the investigating officer was liaising with Interpol to trace the deceased person’s mobile phone and obtain details on the deceased credit and debit card, which are still missing.
Scott’s death
According to Sergeant Philip Kilonzo, attached to the Homicide Investigations Department, the deceased, who disappeared on February 16, 2025, was killed and the body dumped at Makongo Forest along Machakos-Wote Road on February 21, 2025.
Kilonzo also states that the deceased body was tied hands and legs together and thrown in a thicket in a green nylon sack.
“The dead body was tied hands and legs together and put in a green nylon sack and thrown in a ditch about 500 meters from the Makongo forest viewpoint,” part of the application read.
Furthermore, the application states that investigations revealed that the deceased was taken to Pipeline at Alex Mutua’s house, where he is believed to have been murdered, and the body disposed of at Makongo.
Later, the two were accused of attempting to withdraw money from the deceased person’s account within Nairobi, Voi, and Mombasa.
He states that the two were involved in the murder and both were arrested on March 21, 2025, along the Nairobi-Machakos road.
The case will be mentioned on March 24, 2025, for further directions.
